Your position when a purchase turns out to be faulty
Several overlapping protections apply, and which one helps depends on how the purchase was paid for.
Written warranties are enforceable on their terms, and federal law requires those terms to be available before purchase. Separately, most sales carry implied warranties that goods are fit for ordinary use, unless the seller has disclaimed them in the manner the law requires.
Paying by credit card adds a distinct route: federal law allows a cardholder to withhold payment for a disputed purchase in defined circumstances, and card networks operate their own chargeback processes with their own time limits.
State consumer protection statutes cover deceptive practices, and many of them allow recovery of costs that make a small claim worth pursuing. A number require a written demand before a claim can be brought, which is covered elsewhere on this site.
The practical order is to contact the seller in writing, then the manufacturer, then the card issuer, keeping dates and copies throughout. Escalating without that record is what makes a legitimate complaint hard to resolve.
